This action was commenced by the plaintiffs Dorothy Schandelmeier and Joseph Schandelmeier, husband and wife, to recover damages for injuries sustained by Mrs. Schandelmeier when she fell down the cellar stairs in the home of the defendants George I. Brown and Agnes Brown. In their answer, the Browns denied any negligence, alleged Mrs. Schandelmeier was negligent, and moved for summary judgment dismissing the complaint. The trial court denied the motion on the ground an issue of a material fact existed and from that order the Browns have appealed.
